1. Acceptance of Terms

By accessing or using Symple Leases’ website, mobile app, or any related services, you agree to be bound by these Terms of Use, our Privacy Policy, and any additional guidelines or terms referenced herein. If you do not agree, you must not use the platform. These Terms constitute a legally binding agreement between you and Symple Leases, Inc.

2. User Types and Responsibilities

Symple Leases provides services to multiple user types:

Property Owners/Managers/Hosts: Can list properties, manage listings, process payments, and schedule inspections. Responsible for compliance with applicable laws and providing accurate information.
Renters/Buyers: Can browse and apply for properties, submit payments, and communicate with owners/managers. Responsible for providing accurate information and honoring lease agreements.
Service Providers: Offer cleaning, maintenance, and guest services. Must comply with all laws, maintain insurance, and adhere to quality and performance standards.
Administrators: Oversee platform compliance, moderate user content, and manage disputes. Users agree to provide accurate and truthful information, maintain the security of their accounts, and comply with all applicable laws and platform policies.

3. Use of Services and Prohibited Activities

Users agree to use the platform solely for lawful purposes. Prohibited activities include, but are not limited to:

Submitting false or misleading information.
Engaging in fraud, harassment, or illegal activities.
Unauthorized access, scraping, data mining, or copying of platform content.
Circumventing platform security or attempting to interfere with the operation of the platform.

4. Payments and Billing

Payments for services, subscriptions, and other transactions are processed through secure third-party payment gateways (e.g., Stripe, PayPal). Users authorize Symple Leases to collect and process payments, including applicable fees. Refunds, if granted, are processed within 10 business days in accordance with the Refund Policy. Symple Leases is not liable for payment disputes, delays, or errors.

5. Refund and Cancellation Policy

Please refer to our Refund & Cancellation Policy for full details. Refunds are considered on a case-by-case basis for unresolved service issues and processed within 10 business days. Users may cancel subscriptions at any time via the platform. Cancellations are effective immediately; no refunds will be issued for the current billing period. Symple Leases reserves the right to deny refunds for misuse, fraud, or violations of these Terms.

6. Disclaimers and Limitation of Liability

Symple Leases provides its services "as is" and disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, Symple Leases is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use the platform, including but not limited to loss of profits, data, or goodwill. User disputes, including those between property owners and renters or service providers, are solely the responsibility of the parties involved.

7. Indemnification

You agree to indemnify, defend, and hold harmless Symple Leases, its affiliates, employees, agents, and partners from any claims, losses, liabilities, damages, costs, or expenses, including reasonable attorneys' fees, arising from your use or misuse of the platform, your violation of these Terms, or your violation of any rights of a third party.

8. Intellectual Property

All content, including text, graphics, logos, software, and other materials, is the property of Symple Leases or its licensors and protected by intellectual property laws. Users may not reproduce, distribute, modify, or create derivative works without express written consent.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California without regard to its conflict of law provisions. Disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA). No class actions are permitted, and the prevailing party is entitled to recover legal fees and costs.

10. Modifications to Terms

Symple Leases reserves the right to modify these Terms at any time. Users will be notified of significant changes. Continued use of the platform constitutes acceptance of the updated Terms.
